Earlier this week, the state overturned a decision regarding an asbestos lawsuit that was first decided in June 2010. The lawsuit claimed that the makers of a brake grinding machine were negligent in causing mechanics to develop asbestos-related diseases.
The lawsuits claim that the brake shoe grinding machines released asbestos as a result of grinding the brake’s linings. The lawsuits were filed by a mechanic that developed asbestosis and three families that lost loved ones due to an asbestos-related disease in 2007 and 2008.
The machine’s maker, Hennessy Industries, claimed that they were not at fault because their machine did not use asbestos. The decision was recently overturned when it was discovered that asbestos is emitted as a result of grinding brake’s linings.
