A Dallas family was recently awarded $9 million in a mesothelioma wrongful death lawsuit filed against Dow Chemical Co. and Alcoa Inc. Husband and Father Robert Henderson passed away after contracting mesothelioma, a rare form of cancer related to exposure to asbestos.
Henderson worked at Dow for 10 months in 1967, and later at Alcoa for 29 years. One of the major issues of the trial was determining the percentage Dow and Alcoa would pay to the Henderson family. While Henderson worked at Dow for less than a year, the exposure to asbestos he experienced there was much greater than that of his time at Alcoa. For this reason, the court determined that Dow was responsible for paying 30 percent of the verdict, and Alcoa, 70 percent.
