The government prosecution in the WR Grace trial in Missoula, Montana is under scrutiny for their practices. The defense has asked Judge Molloy to completely dismiss the case and acquit their clients because of the prosecution's "repeated and intentional" misconduct including allowing testimony that they knew to be false.
Judge Molloy has been voicing his doubts about the prosecution's tactics lately, giving creedence to the defense. He has also pointed out that there has been little evidence of conspiracy which is a major charge against the five executives. On Thursday, Molloy issued an order to throw out several of the prosecution's exhibits on the basis of not trusting them to do the right thing.
