On Thursday, an Illinois Supreme Court ruling changed the way that asbestos trials will be carried out. Since 1987, a precedent has been followed that does not allow a jury to know about asbestos exposure that may have occurred outside of the defendants power. This precedent was struck down in a five to one decision.
Now, juries will be more informed in asbestos trials. The entire asbestos exposure history of the plaintiff will be available to juries to allow them to make informed decisions about the extent of the defendants' liability. This should significantly reduce the number of appeals by asbestos case defendants.
