A Pennsylvania Superior Court has ruled that an in state company, Crown Cork & Seal Co, has limited liability to mesothelioma sufferers who were exposed to asbestos by the company. However, this may be unconstitutional based on the Equal Protection Clause and the Commerce Clause. This is because allowing limited liability would grant a right to in state companies that would not apply to out of state companies.
This case will be brought before the Pennsylvania Supreme Court for a decision. If ruled unconstitutional, the companies that expose workers to asbestos will be liable for their actions as long as there are injured parties. However, if the vote swings the other way, workers who have suffered and are suffering from mesothelioma may not be able to hold the responsible parties accountable after a certain dollar amount has been paid.
