The Wisconsin Supreme Court has ruled that each sufferer of mesothelioma constitutes a seperate occurrence under insurance policies. This means that a company cannot simply make one large payout for people who develope mesothelioma as a direct cause of their actions or inaction. Instead, they must take each worker on a case by case basis as they bring up their mesothelioma suits.
This ruling comes in the wake of an appeal by Plastics Engineering Co, or Plenco, when their insurer argued that they should only be held accountable for a single occurrence, the decision to use asbestos. The new ruling will allow Plenco to obtain more insurance for mesothelioma cases. It also means that workers who were exposed to asbestos will each get their own case and will be awarded accordingly.
